Terms and Conditions
Packserve Limited offers the Marketplace as a way for owners of used equipment to resell it; we merely act as a vehicle for putting buyers and sellers of used equipment in touch with each other.
Packserve Limited does not offer any warranties or guarantees of any kind for the goods appearing on the Marketplace
Packserve Limited will not be liable for any consequential losses, liability for which is hereby completely excluded.
Packserve Limited does not guarantee that items appearing for sale in the Marketplace are fit-for-purpose, are owned solely by the advertiser or that they are free from outstanding finance.
All specifications, performance capabilities and production statistics stated in any technical literature or in any other documentation should be regarded as indicative only. Notwithstanding the aforementioned any performance indication is subject to the Buyer having proved themselves prior to purchase, Packserve Limited accepts no responsibility for the equipment specifications stated in any offer.
It is the responsibility of the buyer to arrange delivery and transportation unless agreed otherwise. Packserve Limited will not be liable for any losses however so incurred due to delays caused by transit problems or any other factor.
Where applicable, the Buyer is responsible for ensuring that all necessary import licences and other required governmental or municipal or import permissions have been obtained and approval obtained from appropriate authorities for the remittance of all hard currency due under the terms of the contract. The Buyer will be solely responsible for any losses or expenses incurred due to the Buyer's failure to comply with the terms of this clause.
The Buyer is solely responsible for ensuring that his factory premises have been fully prepared so as to allow the installation and commissioning of the goods. In the event that the factory site or premises are not ready to receive the goods or there is a deficiency in the completion of electrical, mechanical or other services which prevent the smooth and continuous process of installation and commissioning, or where there is a deficiency in materials or labour which prevent the smooth and continuous installation and commission as a result of the aforementioned circumstances shall be entirely to the account of the Buyer.
Spare parts should be checked for local availability by the buyer. Packserve Limited accepts no responsibility that the spare part supply is universally adequate for all circumstances.
The Buyer is responsible for insuring the goods under all circumstances from the moment that the goods leave the seller to arriving at the Buyers premises. The Buyer is also solely responsible for arranging cranage and for the handling facilities and the costs thereof.
The prices and terms of payment shall be as stated in the offer, quotation and or pro forma or contract document. Provided that orders are confirmed within the stated validity period, prices remain fixed in GB Pounds. The prices and terms of payment shall be agreed with the buyer and seller only the commissions or advertising costs will be paid directly to Packserve Limited by the seller prior to the sale of the goods to the buyer.
Should the buyer renege on the contact at any stage with the seller Packserve Limited will retain all commission and advertising monies due in such circumstances the responsibility for all costs, losses and charges, however so incurred resulting directly or indirectly form the Buyers failure to meet his obligations on due dates.
All contracts shall be construed as an English contract and subject to the laws of England. Any dispute between the parties hereto regarding any technical, logistical or delivery matter shall be referred to the London Chamber of Commerce Court of Arbitration who shall appoint a sole arbitrator. The arbitrator's decision shall be final and binding upon the parties hereto and not subject to appeal. Notwithstanding the provisions of any contract, offer, quotation or pro forma.
In some circumstances, Packserve Limited may offer to transport, modify and install the equipment purchased via the Marketplace but the nature and cost of this service will be dependant upon the age and condition of the equipment at the time of purchase.
Please make all necessary inspections or checks before agreeing to purchase anything for sale in the Marketplace.
